Many people search for an online divorce or wonder why they need a lawyer to file for divorce if both spouses agree. The answer is that you don’t know what you don’t know. You think it’s simple, but there are issues and problems you may not be aware of. What you want to do may not be legal, or you may be setting yourself up for future problems you can’t foresee. I’ve filed thousands of divorces in Shelby County and across Tennessee, and the mistakes I see from people who tried to do it themselves are almost always things they never saw coming.
The State Forms Often Don’t Apply to Your Situation
The State of Tennessee created standardized forms for people to use to file their own divorces. However, many people have difficulty following the instructions and often get their divorces denied or delayed for failing to fill them out correctly. Here are the common mistakes:
If you own real estate or have retirement accounts, you cannot use the forms at all.
Don’t leave sections blank. This should be obvious, but you can’t just skip sections because you don’t think they apply to you.
Don’t presume that if it isn’t jointly owned, then it isn’t marital property. This is why you can’t use the forms if you have real estate or retirement. Your spouse gains an interest in your property and accounts even if you don’t formally combine them.
If you have children, the parenting plan requirements alone are complex enough to get your case rejected. The court requires specific provisions for custody, visitation schedules, holidays, decision-making, child support, and health insurance, and the standardized forms don’t walk you through any of it.
AI Cannot Replace a Lawyer
Can an AI chatbot replace a lawyer for your divorce? No, not really. Can an actual lawyer use AI to be more efficient and create a similar work product to what a lawyer would manually type? Yes. The problem is the average person will ask AI the wrong questions and not recognize the AI produced a bad product. You don’t know what it is supposed to look like, so courts and lawyers will notice you used AI right away as soon as we look at it. I use AI nearly every day in my practice, but I have it using my own forms and processes, so the AI is using my own work product to build out documents faster. I’m not using it to create new content from scratch.
Using AI instead of a real lawyer can really harm your case. Is it better than just making up documents on your own? Yes, but here’s what happens. You use AI to file an Answer and Counter-Complaint. That gets you past the default judgment danger where the court can grant the divorce without your consent, but you are then exposed to the lawyer pulling you into court where they know all the rules and you will not have the AI to help you in the courtroom. Lawyers and courts get annoyed with people representing themselves because you don’t know what you don’t know and often asks for things you can’t get or bog down the process by doing things that won’t work for your case. When you do that, the lawyers are less likely to make a deal with you and give you a fair deal, and the risk of them demanding attorney fees goes way up. When I have an unrepresented Defendant actively litigating their case against me, I am never trying to screw them or take away anything they are entitled to receive. I am trying to settle the case the way it has to be settled, but the lack of knowledge on the other side often really slows it down and makes it more expensive overall. AI won’t fix these problems for you, so you really do at least need to have a lawyer review your case and tell you if you’re wasting your time.
You Need to Talk to Somebody
The bottom line is that you need to talk to somebody about your situation before you make life-altering decisions. Perhaps your case is simple. Even if it is, it is worth the time and money to pay an experienced Tennessee divorce lawyer to handle it for you so that what is simple, stays simple. AI will lie to you, and you don’t know enough about law to protect yourself from common mistakes if you type your own documents. It won’t take long to find the right path to working things out.
